A BILL to amend article five, chapter sixty-four of the
code of West Virginia, one thousand nine hundred
thirty-one, as amended, by adding thereto a new
section, designated section two, relating to
authorizing the family protection services board to
promulgate a legislative rule relating to the
operation of the board and the licensure and funding
of domestic violence programs.
Be it enacted by the Legislature of West Virginia:
That article five, chapter sixty-four of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, be amended by adding thereto a new section,
designated section two, to read as follows:
ARTICLE 5. AUTHORIZATION FOR DEPARTMENT OF HEALTH AND
HUMAN RESOURCES TO PROMULGATE LEGISLATIVE RULES.
§64-5-2. Family protection services board.
The legislative rule filed in the state register on
the thirtieth day of August, one thousand nine hundred
ninety-six, under the authority of section thirteen,
article two-c, chapter forty-eight, of this code, modified
by the family protection services board
to meet the
objections of the legislative rule-making review committee
and refiled in the state register on the twenty-sixth day
of February, one thousand nine hundred ninety-seven,
relating to the family protection services board
(operation
of family protection services board
and licensure and
funding of domestic violence programs, 191 CSR 1), is
authorized.
NOTE: The purpose of this bill is to authorize the
Family Protection Services Board
to promulgate a
legislative rule relating to the Operation of the Board and
the Licensure and Funding of Domestic Violence Programs
.
